ACCOMPLICE PRODUCTIONS PRIVACY POLICY

This privacy policy (“Privacy Policy”) describes how Accomplice Productions LLC (hereinafter “Accomplice,” “us,” or “our”) collects and uses information about you when you access or use the social games we offer for the web and for mobile devices, including TicStacToe (the “Service”). This Privacy Policy is applicable as of and following the Effective Date posted above. This Privacy Policy is also part of and is governed by the terms and conditions set forth in the Accomplice Productions Terms of Service which are located at http://www.accompliceproductions.com/legal/terms-of-service.

By creating an account to use the Service, or by otherwise accessing, visiting or using the Service, or playing one of the games offered through the Service, you are authorizing us to collect, store and use the information you provide in connection with the Service in accordance with the terms of this Privacy Policy.

If you purchase or access the Service through a third party service that provides a gateway to the Service, such as Facebook or iTunes (a “Gateway Service”), you will have a separate, additional account relationship with that Gateway Service and the information you provide to that Gateway Service will be handled in accordance with the privacy practices of the applicable Gateway Service. Gateway Services are not partners or representatives of Accomplice and Accomplice is not responsible for the acts or omissions of a Gateway Service with regard to the collection or use of your information.

Your privacy is a serious matter to us. This Privacy Policy explains what information we collect in connection with your use of the Service, how the information is used, and with whom we may share this information. Please take a few minutes to read this Privacy Policy so that you understand how we handle the information we collect in connection with the Service.

  1. Information We Collect About You.

    1. Information We Directly Collect from You. We directly collect the following types of information that you voluntarily provide to us through the Service:

      • Identifying Information. We may collect information from you that can be used to personally identify and/or contact you. Identifying information collected through the Service may include your email address, or, if you make a purchase through the Service, your name and billing address.

By logging in to the Service through a Gateway Service, you are granting us permission to access, store and use any information that you permit the Gateway Service to share with us in accordance with your privacy settings for that Gateway Service. We encourage you to review, and if necessary, adjust, your privacy settings on each Gateway Service before logging in to the Service through a Gateway Service. Information that we receive from a Gateway Service is stored and used by Accomplice in accordance with this Privacy Policy.

    4. Information That You Choose To Provide. You may provide information about yourself when you communicate or “chat” with other users of the Service. Any information that you provide as part of these communications may be viewed by other users of the Service and the public. If you elect to communicate on the Service we recommend that you do not provide any identifying information or other information that you do not want to make publicly available. You are solely responsible for any loss of privacy or other harm resulting from the information you provide as part of your communications with other users of the Service.

    5. Information That We Automatically Collect From Your Computer. We (or service providers on our behalf) may automatically collect information from you using “cookies”. Cookies are small amounts of data that are stored within your computer’s Internet browser and that are accessed and recorded by the websites that you visit so that they can recognize the same browser navigating online at a later time.

      Information collected by cookies may include, without limitation:

      • The date and time of your visit to the Service;

      • The Internet Protocol (IP) address used to connect your computer to the Internet;

      • The amount of time you spend visiting a particular page within the Service; and/or

  3. Collection of Information by Third Parties.

    If you visit the Service from a third-party website the third-party website may give you a unique code, cookie or graphic which will uniquely identify you. This will only happen if you link directly from a third party website to the Service. Your activities on the Service while such a code is active may be reported back to the third party website. The presence of a third party navigation bar at the top of a webpage is an indication that the third party website may be able to see your activity on the Service.

    The Service may include third-party advertising, links to other websites, and other content from third-party businesses. These third-party websites, businesses, and advertisers, or advertising companies working on their behalf, may use web beacons and cookies to measure the effectiveness of their ads, personalize or optimize advertising content and to track users who click on the links made available through the Service. We do not have access to or control over web beacons or cookies that these third parties may use. We are not responsible for the privacy practices or the content of these third-party websites.     We may also provide social media features through the Service that enable you to share information with your social networks and to interact with the Service on various social media sites. Your use of these features may result in the collection or sharing of information about you by these sites, depending on the feature. We encourage you to review the privacy policies and settings on the social media sites with which you interact to make sure you understand the information that may be collected, used, and shared by those sites.

  4. How We Share Personal Information with Third Parties. We may share the information we collect in connection with the Service with the following third parties:

    1. Our Service Providers. We may share your information with third party contractors or service providers who provide certain services to us or on our behalf, such as operating and supporting the Service. These service providers will only have access to the information needed to perform these limited functions
      on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Service.

    2. Our Affiliates. We may share some or all of your information with our parent company, subsidiaries and corporate affiliates, joint venturers, or other companies under common control with us. We will require these entities to comply with the terms of this Privacy Policy with regard to their use of your information.

    3. Companies that Acquire Our Business or Assets. If our company or our assets are acquired by, transferred to or merged with another company, that company may acquire the information collected by us. We will require the applicable company to assume the rights and obligations that are applicable to your information at the time of the acquisition, transfer or merger.

    4. Law Enforcement Authorities. We may disclose your information if required to do so by law or to comply with valid legal process (such as a search warrant, subpoena or court order), to protect our rights or property, or during emergencies when safety is at risk.
      We will obtain your consent prior to sharing your Personal Information with any third party not described above.

  5. How We Protect Your Information. We have implemented reasonable physical, electronic, and procedural safeguards to protect the information we have collected about you in connection with or through the Service from unauthorized use, misuse, disclosure, loss and alteration. You must understand, however, that we cannot guarantee the absolute security of your information, and that no networked system or Internet transmission is totally secure. We assume no responsibility or liability if any information relating to you is intercepted and/or used by an unintended recipient.

  6. Correcting/Updating Your Information. If your email address or other contact information that you provide to us changes, you may update, correct or omit the relevant information by contacting us using the contact information provided in Section 11 below.

  7. No Use by Children. The Service is not intended for use by children under the age of thirteen (13). We will never knowingly collect information directly from children under the age of thirteen (13) without verifiable parental consent. If you are under the age of thirteen (13), please do not provide us with information of any kind whatsoever. If we become aware that a user is under the age of thirteen (13) and has submitted information to the Service without verifiable parental consent, we will remove his or her information from our files. We understand that children may not fully understand all of the provisions of this Privacy Policy or make informed decisions about the choices that are made
    available to adult users of the Service. We encourage parents and guardians to spend time with their children online and to be familiar with the websites they visit.

  8. Use of Information Outside of Your Country of Residence. The Service is directed to users located in the United States. If you are located outside of the United States and choose to use the Service or provide your information to us, you should be aware that we may transfer your information to the United States and process it there. The privacy laws in the United States may not be as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to such transfer.

  9. Changes to this Privacy Policy. We will occasionally update this Privacy Policy to reflect changes in our practices and services. We will post any material changes to this Privacy Policy on the Service with a notice advising of the changes at least thirty (30) days before the effective date of the changes. You may cancel your account prior to the end of the applicable thirty (30) day period by contacting us using the contact information in Section 11 below. If you choose to cancel your account within this thirty (30) day period, you will not be bound by the terms of the revised Privacy Policy, but any information you provided to us prior to cancellation will be subject to the terms of this Privacy Policy.

  10. Retention of Personal Information. We will retain your information while your account with us is active, and from closed or inactive accounts to the extent and as long as it is necessary and relevant for our operations and to comply with law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce the Accomplice Productions Terms of Service, and take other actions otherwise permitted by law.
